Buying property in Spain can hold surprises. To help you understand what is at stake with hidden defects, here is an overview of this concept, which every buyer should know, especially in a foreign country.
We explain everything.

In property, a hidden defect is a flaw that is not visible when the property is inspected before purchase.
To count as a hidden defect, the flaw must make the property unfit for its intended use or reduce its usefulness and/or quality so much that the buyer would not have bought it (or would have paid less) had they known about it.
In Spain, the definition of vicios ocultos (hidden defects) is set out in the Spanish Civil Code, specifically article 1484.
In Spain, the buyer can take legal action for hidden defects within six months of the property being handed over, for a defect that could not be seen until then.
Mediation or negotiation with the seller can be an alternative to going to court, but it does not always work. It is better to plan ahead, especially when buying from abroad.

In countries like Spain, legal certainty around property transactions is crucial.
