Buying a home or investing in Spain from the United States

Americans can buy property in Spain like anyone else. What differs is how long you can stay, how Spain taxes the property and what you report to the IRS. Our English-speaking team knows what US buyers need and takes you through each step.

What changes when you buy from the US

Three points to plan before you start viewing properties.
Colourful facades and boats moored in a marina in the Valencian Community
The 90/180-day rule
A Spanish home does not come with the right to live in Spain. As a US citizen, you can stay up to 90 days in any 180-day period in the Schengen area without a visa. Since April 2026, the EU's Entry/Exit System has recorded entries and exits with fingerprints and a photo at every border. ETIAS, the online travel authorisation planned for visa-free visitors, has not started yet.
Rental income taxed in Spain
Residents of the US pay Spanish non-resident tax on rent at 24% of the gross amount, and no expenses can be deducted. When the home is empty or used by you, Spain taxes a notional income based on its cadastral value instead. You declare both on form 210, generally once a year in April for rent earned since October 2026.
Tax in the US
US citizens are taxed on their worldwide income, wherever they live, so the rent and any gain on sale also go on your US return. You can usually claim a foreign tax credit for the Spanish tax, and the Spain-US tax treaty sets which country taxes what. Speak to a tax adviser who knows both systems before you sign.
“Spain is an overnight flight away. How do I choose a property from here?”
We screen properties for you, run video viewings and send detailed reports. You travel only to see a shortlist, or not at all if you prefer to sign through a power of attorney.
“The process looks nothing like buying at home.”
In Spain, you usually sign a private contract with a deposit, then sign the deed before a notary, and the purchase is recorded at the land registry. Before you sign anything, we check the registry, debts, planning status and permits, and we guide you until you get the keys.

“Can we rent it out when we are not there?”
Possibly, but check before you buy. Holiday lets must be registered under the rules of each region, some towns restrict or freeze new ones, and since April 2025 starting one in a building or estate with a community of owners requires the approval of three fifths of the owners. We look at these rules for each property with you.

At Alveo Search, we know these challenges. Let's talk about them.

Frequently asked questions

The questions buyers from the United States ask us most often.

Can Americans buy property in Spain?

Yes. Spain does not restrict property purchases by nationality. You need a NIE, the foreigner identification number, and usually a Spanish bank account, and we handle both steps with you. A 2025 bill proposed a new tax on property bought by people living outside the EU. It never became law and lapsed when the Spanish Parliament was dissolved in October 2026.

Can I live in Spain for longer than 90 days?

Only with a visa, which you apply for at the Spanish consulate that covers your state. The non-lucrative visa is for people who will not work and can show sufficient funds and health insurance. The digital nomad visa is for remote work for employers or client companies outside Spain. Both ask for an FBI background check with an apostille and a translation into Spanish. The golden visa ended on 3 April 2025. Our guides explain the non-lucrative visa and the 90/180-day rule, EES and ETIAS.

Do I have to report my Spanish home or bank account in the US?

A home you own in your own name does not go on Form 8938: the IRS does not treat foreign real estate held directly as a financial asset. Your Spanish bank accounts do count. You file an FBAR with FinCEN if your foreign accounts together exceed $10,000 at any time in the year, and Form 8938 may also apply above its own thresholds.

Which taxes do I pay in Spain, while I own the home and when I sell?

Each year, the IBI, the local property tax, and non-resident income tax: 24% on the gross rent, or on a notional income when the home is not rented. Spain's wealth tax applies to non-residents only on assets located in Spain, after an allowance of €700,000, and the solidarity tax on large fortunes only on taxable wealth above €3 million. When you sell, Spain taxes the gain at 19%, and the buyer withholds 3% of the price on account of your tax.

Do I need to be in Spain to sign?

No. You can sign a power of attorney before a US notary and have it apostilled by the authority of the state where it was notarised, usually the Secretary of State, then translated into Spanish. You can also sign it at a Spanish consulate. The person you appoint then signs on your behalf, and we organise the signing with you.

What does buying cost, and can I get a mortgage in Spain?

Count on roughly 10 to 15% of the price for taxes, notary, land registry and fees. The largest item on a resale property is the transfer tax, which each region sets, and we give you a detailed estimate for every property you consider. Spanish banks lend to non-residents, usually for a smaller share of the price than for residents. Alveo Finance, the Alveo group's mortgage broker, can look at the options with you. You pay in euros, so the dollar to euro exchange rate affects your budget.
