Buying a home or investing in Spain from Germany

As an EU citizen, you can buy, stay and settle in Spain freely. The questions are where to buy, whether the property is legally sound and how the rent is taxed in Spain and in Germany. Our English-speaking team knows what buyers from Germany need and supports you from the search to the signing.

What changes when you buy from Germany

Three points to plan before you start viewing properties.
Colourful facades and boats moored in a marina in the Valencian Community
Free movement as an EU citizen
German citizens can live in Spain without a visa or permit, and the Entry/Exit System does not concern them. Moving there for more than three months means registering in the Central Register of Foreign Nationals within three months of arrival, which gives you an EU citizen registration certificate. For tax, more than 183 days in Spain in a calendar year, or your main economic interests there, make you a Spanish tax resident.
Rental income taxed in Spain
While you remain tax resident in Germany, Spain taxes the rent you earn there at 19%, the rate for EU and EEA residents, on the amount left after rental expenses. When the home is not let, Spain taxes a notional income instead, worked out from its cadastral value. Both are declared on form 210, generally once a year in April for rent earned since October 2026.
Tax in Germany
Under the 2011 tax treaty between Spain and Germany, Spain taxes the rent first. Germany then includes the same rent in your German return and deducts the Spanish tax from the German tax due on it. The same method applies to the gain when you sell. A Steuerberater can tell you how this works out in your case.
“We want a home for part of the year, maybe more later. Where should we look?”
The right area depends on how you will use the home: a few weeks a year, long winters or a full move. We compare areas on climate, services, healthcare and access, then narrow the search with you.
“Can we let it to holidaymakers when we are not there?”
Possibly, but check before you buy. Holiday lets must be registered under the rules of each region, some towns restrict or freeze new ones, and since April 2025 starting one in a building or estate with a community of owners requires the approval of three fifths of the owners. We look at these rules for each property with you.
Thomas on a viewing in Spain
“I cannot travel to Spain for every viewing.”
We pre-visit properties for you, send videos and detailed reports, and only plan a trip for your shortlist. You can also sign through a power of attorney.

At Alveo Search, we know these challenges. Let's talk about them.

Frequently asked questions

The questions buyers from Germany ask us most often.

How do I get a NIE?

You need a NIE, the foreigner identification number, to buy, sign at the notary and pay Spanish taxes, even if you never live in Spain. You can apply at a Spanish consulate in Germany or in Spain, with the purchase as the reason, or receive it when you register as a resident. We handle the application with you.

Which expenses can I deduct from my Spanish rental income?

As an EU resident, you deduct the expenses directly linked to the rental: IBI property tax, community fees, insurance, repairs, mortgage interest and the depreciation of the building, for example. Each expense must be justified and related to the income earned in Spain, so keep every invoice.

Which taxes do I pay in Spain each year as an owner?

The IBI, the yearly local property tax, and non-resident income tax at 19%, on the net rent or, if you do not rent the home, on a notional income. Spain's wealth tax applies to non-residents only on assets located in Spain, after an allowance of €700,000, and the solidarity tax on large fortunes only on taxable wealth above €3 million.

What happens when I sell?

Spain taxes the gain at 19%. As you are not resident in Spain, the buyer withholds 3% of the price and pays it to the Spanish tax office on account of your tax. If the 3% is more than the tax due, you claim the difference back. Under the treaty, Germany can tax the gain too and credits the Spanish tax. Under German rules, a private property sold more than ten years after purchase is generally not taxed in Germany.

Do I need to be in Spain to sign?

No. You can sign a power of attorney before a German notary, have it apostilled by the authority your notary indicates, usually the president of the Landgericht depending on the Land, then translated into Spanish. You can also sign it at a Spanish consulate in Germany. We organise the signing with you.

What does buying cost, and can I get a Spanish mortgage?

Count on roughly 10 to 15% of the price for taxes, notary, land registry and fees. The largest item on a resale property is the transfer tax, which each region sets, and we give you a detailed estimate for every property you consider. Spanish banks lend to non-residents, usually for a smaller share of the price than for residents. Alveo Finance, the Alveo group's mortgage broker, can look at the options with you.
